AUCTION NOTES
· This is an LIVE auction with Simulcast ONLINE bidding.
· FFL Dealers will be on site. No FFL Background Check Fee
· Personal Property: A 15% Buyer's Premium & 5.5% General Sales Tax will be added to the highest bid to arrive at the total purchase price.
Payment in full is required before purchases may be removed from the premises. Payment options: Cash, check (payable to Fowler Auction) or credit card on file (or other card).
· ALL REGISTERED BIDDERS WHO PLAN TO BID ON A FIREARM OR AMMO MUST BE 21 YEARS OF AGE OR OLDER & MUST PASS AN FBI BACKGROUND CHECK.
· FIREARMS: All applicable gun laws will be observed. All Buyers must provide a valid identification showing age. A FBI background check must be performed and passed before possession of any firearm will be transferred to any Buyer. If the Buyer is unable to take possession of the firearm, a 20% restocking fee will be assessed on the winning bid and the Buyer's Premium forfeited. (In other words, if you cannot pass the background check, do not bid on firearms.)
· FIREARM TRANSFER: After a background check for an Alabama resident of 21 years or older has been passed, firearm(s) will be transferred to the Buyer. Non-Alabama residents: Please provide David Vess a copy of the destined FFL’s certificate, phone number and address. Email this information to [email protected]. FFL is Buyer’s choice and firearm(s) will be shipped to that destination. Buyer is solely responsible for any fees in addition to the FBI background check that the designated FFL charges.

* All registered Bidders MUST BE 21 years of age or older.
A 15% Buyer's Premium & 5.5% Sales Tax will be added to the highest bid price to arrive at the final purchase price. Payment in full by cash, check payable to Fowler Auction, credit card or cashier's check is due auction day before purchases leave Fowler Auction. All sales are final.
All sales are subject to Alabama sales tax, unless you have an Alabama sales tax exemption number. A sales tax number must be included in your Fowler Auction ONLINE Bidding Profile and a certificate MUST be presented to Fowler Auction for our records.
All lots are subject to owner confirmation.
MAXIMUM BID: When you bid your maximum bid, the current bid price does not automatically advance to your maximum bid. Another Bidder has to bid to increase the current price and the bidding platform will automatically bid up to your maximum in the increments specified.
SERVER, SOFTWARE TECHNICAL OR INTERNET ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Fowler Auction reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE NOR FOWLER AUCTION & REAL ESTATE SERVICE, INC. SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Fowler Auction & Real Estate Service, Inc.

DEFAULT: If purchases are not settled by the specified pick up day, it will be considered in default. Upon default the bidder will be black listed/blocked from bidding on Fowler Auction & Real Estate Service, Inc.'s auctions, as well as MarkNet Alliance auctions and may be charged 10% of bid price or $500, whichever is greater. All defaulted items may be offered to the next highest qualified bidder at the discretion of Fowler Auction & Real Estate Service, Inc.
Any dispute between Fowler Auction & Real Estate Service, Inc., its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Madison County, Alabama (or county designated by Fowler Auction). By bidding either in person or online, Buyer agrees to all terms and conditions set forth.
We do assist Buyer in loading equipment; however, each Buyer is responsible for his own items. Buyer is responsible for securing his own load. Fowler Auction is not responsible for any damage incurred to equipment or vehicles while loading.
Buyer and/or Bidder agrees to hold harmless and indemnify Fowler Auction & Real Estate Service, Inc. and its Agents and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
